The State of California's Chief Executive Newsom Files Lawsuit Against Donald Trump Over State Guard Deployment to Portland

California Governor Gavin Newsom stated on Sunday that he is taking legal action against Donald Trump regarding the alleged sending of three hundred Californian national guard personnel to the state of Oregon.

“They are on their way there now,” the governor stated in a press statement. “The Trump Administration is unapologetically challenging the judicial framework itself and implementing their risky statements – defying legal directives and treating the judiciary, including those named by the President, as foes.”

Legal Background and National Ruling

Newsom’s proposed lawsuit is in response to a federal judge’s ruling that halted the federal government from sending the state guard of Oregon to the city of Portland. Judge Karin Immergut agreed with assertions that it would inflame rather than calm tensions in the urban area.

The judge ruled in her order, which postpones deploying the guard until at least the 18th of October, that there was a lack of evidence that the current demonstrations in Portland justified the decision.

Local Authorities React

Caroline Turco, Portland’s senior deputy attorney, noted that there had been no violence against immigration officials for months and that current rallies were “sedate” in the period before the national leader declared the metropolis to be a war zone, sometimes including fewer than a dozen demonstrators.

“This issue goes beyond safety, it concerns authority,” Governor Newsom asserted. “Legal action will be our response, but the people should speak out in the presence of such dangerous and dictatorial conduct by the President of the United States.”

State Legal Chief Comments

Via a public comment on social media, Dan Rayfield expressed that the state is reviewing possible actions and preparing to take legal action.

“The administration is obviously hellbent on using the military in U.S. urban centers, without evidence or authority to do so,” his statement said. “The duty falls on us and the legal system to ensure accountability. This is our plan.”

National and State Response

The California national guard directed inquiries to the Department of Defense. A official representative declined to comment. There was silence from the presidential administration.

National Background

The report from Oregon came just a day after Trump ordered the sending of state guard forces to Chicago, the most recent in a series of similar operations across several states in the U.S..

The President had initially revealed the initiative on the 27th of September, claiming he was “authorizing full force, if necessary” regardless of requests from Oregon officials and the elected officials, who reported there had been a one, calm rally outside a federal agency location.

Past Background

For years, Trump has amplified the account that the city is a “war-ravaged” city with radicals involved in chaos and criminal acts.

Earlier in his administration in 2020, he sent federal forces to the metropolis in the midst of the rallies over the murder by officers of a citizen in Minneapolis. The unrest spread across the United States but were especially heightened in that city. Despite rallies against federal authorities being modest in size in the region this year, Trump has pointed to them as grounds to dispatch personnel.

Speaking via social media about the latest move from Trump, the governor commented: “It is outrageous. This goes against American values, and action is needed to halt it.”
